JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Earlier prayer for anticipatory bail of the petitioner was allowed conditionally by this Court vide order dated 30.7.2018 passed in Cr.Misc.No. 40936 of 2018 on payment of Bank Draft of Rs.88,000/- in favour of South Bihar Power Distribution Company Limited and rest of the amount was directed to be deposited in seven equal instalments in seven months payable in the first week of each month. However, learned counsel for the petitioner submits that as petitioner could not arrange the first instalment he could not surrender and prays for further time to pay the first instalment and rest of the amount in terms of order dated 30.7.2018 passed in Cr.Misc.No. 40936 of 2018.

Having heard both sides and in the facts and circumstances, further two weeks time from the receipt of this order is allowed to the petitioner to deposit Bank Draft of Rs.88,000/- payable in favour of South Bihar Power Distribution Company Ltd. and rest of the amount in seven equal instalments as per order dated 30.7.2018 passed in Cr.Misc.No. 40936 of 2018.
However, it is made clear that no further time is extended and it is also made clear that if no such amount is deposited there shall be no effect of this order. With the above observation, this application is disposed of.
