2. The notice has been received by the son of the informant and accordingly, the service of notice is treated to be valid but none has appeared on behalf of the opposite party no. 02.

3. The petitioner seeks bail in connection with Bhawanipur P.S. Case No. 46 of 2024 registered for the offence under Sections 137(2), 96, 3(5) of the BNS and later on Sections 4 and 6 of the POCSO Act and under Section 9 of the Prohibition of Child Marriage Act.

4. As per the prosecution case, the petitioner is

Patna High Court CR. MISC. No.269 of 2026(4) dt.22-04-2026 2/2 accused of abducting the victim.

5. The petitioner is in custody since 8.10.2025 and from the reading of the FIR, it appears that the victim has eloped with the petitioner.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Bhawanipur P.S. Case No. 246 of 2024.

8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
