The petitioner is apprehending his arrest in connection with Fatehpur P.S.Case No.229 of 2018 dated 5.8.2018 , registered for offences punishable under Sections 420, 406/34 of the Indian Penal Code and Section 7 of the Essential Commodities Act.
Allegation is about recovery of 48 bags altogether 24 quintal of rice from the Pick-up Van and the owner of the Pick Up Van disclosed that the same is of the petitioner who is a P.D.S. Dealer.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession and his name transpired on confessional statement of the co-accused. Heard learned A.P.P. also.

No.78030 of 2018(2) dt.04-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM X, Gaya in connection with Fatehpur P.S.Case No.229 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
