JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 The petitioner apprehends his arrest in connection with Manjhi P.S.Case No. 262 of 2018 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 . Allegation is of recovery of 23.750 litres of English wine from two motorcycles and one accused is arrested while petitioner succeeded in fleeing away.

Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner and he has no criminal antecedent also. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail

No.77759 of 2018(2) dt.02-01-2019 2/2 upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cumSpecial Judge, Excise, Saran at Chapra in connection with Manjhi P.S. Case No. 262 of 2018; subject to condition as laid2018 down under Section 438(2) of the Code of Criminal Procedure.
