The petitioner seeks bail in anticipation of his arrest in connection with Kadamkuan P.S. Case No. 593 of 2019 dated 08.09.2019 instituted for the offences under Sections 25(1-B)A/35 of the Arms Act.
Though the petitioner is named in the First Information Report but on the basis of statement made by one Md. Samad @ Saheb, who has made a confession before the police that it was at the instance of the petitioner
Patna High Court CR. MISC. No.87433 of 2019(3) dt.26-06-2020 2/3 that he carried the weapon and had also shot at somebody. Mr. Sharma, learned senior counsel for the petitioner has submitted that because of such confession made by Md. Samad @ Saheb, another case under section 307 of the Indian Penal Code was also instituted in which also the petitioner has been made accused. In that case, the petitioner has been granted anticipatory bail. The present case and the case about which reference has been made earlier, are the two cases which have been lodged against the petitioner.
Regard being had to the nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XII, Patna, in connection with Kadamkuan P.S. Case No. 593 of 2019, subject to the condition laid down under Section 438 (2) of the Code of
