The petitioner is in custody since 30.04.2018 in connection with Alamganj P.S. Case No. 196 of 2018 for the offence registered under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case on mere suspicion. The petitioner was asked to stop the vehicle (Activa Scooty) and he was taken into custody alleging that the said vehicle was stolen vehicle. It is further submitted that the petitioner is merely a pillion rider and the vehicle (Activa Scooty) was recovered from the joint possession and therefore, considering that the petitioner has

Patna High Court Cr.Misc. No.76895 of 2018(2) dt.10-01-2019 2/2 been in jail for more than eight months, the petitioner may be extended the privilege of bail.

Considering the aforesaid facts and circumstances of the case and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Patna City in connection with Alamganj P.S. Case No. 196 of 2018.
