JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This application, for grant of anticipatory bail, arises out of Narpatganj P.S. Case No. 433 of 2019, disclosing offences under Sections 147, 148, 341, 323, 307, 354, 504 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against petitioner no. 1 is of assault to the informant by means of farsa and there is also allegation against petitioner no. 2 of assaulting the informant. Submission of learned counsel for the petitioners is that so far petitioner no. 2 is concerned, no specific allegation has been attributed to him and a title suit is pending between the parties. Further submission is that there is allegation of assault against petitioner no. 1 also but injury sustained by the
Patna High Court CR. MISC. No.86613 of 2019(2) dt.22-01-2020 2/2 informant was found simple in nature except one injury. Heard learned A.P.P. also.
Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 433 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
