The petitioner in this case is seeking anticipatory bail in connection with Sakra P.S. Case No.466 of 2019 registered for the offences punishable under Sections 420, 467, 468, 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that nothing has been recovered from the conscious possession of this petitioner. Learned APP for the State is present and has opposed the prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.84437 of 2019(2) dt.19-12-2019 2/2 wherein the allegation is that the illicit liquor has been recovered from the toilet situated inside the house of the petitioner and one of the seizure list witnesses is father of the petitioner himself, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. This application is dismissed. In case, the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered on the basis of the materials collected in course of investigation without being prejudiced by the order of this Court. All contentions are left open for the petitioner.
