JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 The petitioner apprehends her arrest in connection with Balrampur P.S.Case No. 129 of 2018 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation as per FIR is of recovery of 35 and odd litres of wine from a tempo and petitioner happens to be the owner of the tempo.
Submission of learned counsel for the petitioner is that petitioner is a lady and tempo was under the control of driver and she has nothing to do with the seized articles and she has no criminal antecedent.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within
Patna High Court Cr.Misc. No.78042 of 2018(2) dt.04-01-2019 2/2 a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum- Special Judge, Katihar in connection with Balrampur P.S. Case No. 129 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
