JUSTICE BIRENDRA KUMAR ORAL ORDER 23-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Darauli P.S. Case No.171 of 2019, registered for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 30(a)/38(i) of the Bihar Prohibition and Excise Act, 2016.

From the house of the petitioner huge quantity of liquor was recovered. The petitioner has stated on oath that he has got no criminal antecedent.

Considering the presumption of law under the Bihar Prohibition and Excise Act, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused.
