JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 This application, for grant of anticipatory bail, arises out of Banshi P.S. Case No. 14 of 2017, disclosing offences under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
Petitioner happens to be Panchayat Secretary and allegation against him that he in connivance with Mukhiya and others has made forged appointment on the post of teacher. Submission of learned counsel for the petitioner is that he has not been named in the F.I.R, his name surfaced in this case only on the basis of suspicion and he has falsely been implicated in this case. It has further been submitted that the beneficiaries, who are said to have obtained the employment on the basis of forged documents have already been enlarged on anticipatory bail by coordinate Benches of this Court vide order
Patna High Court Cr.Misc. No.77787 of 2018(2) dt.02-01-2019 2/2 dated 24487 of 2017 as well as vide order dated 18.07.2017 passed in Cr. Misc. No. 28274 of 2017.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Six Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Arwal, in connection with Banshi P.S. Case No. 14 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
