JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This is an application for grant of anticipatory bail in connection with Madhepura P.S. Case No. 125 of 2017, disclosing offences under Sections 419, 420 of the Indian Penal Code and Section 10 of the Bihar Examination Act. Allegation against the petitioner as per F.I.R. is that he has allowed another person to sit in his place in the Annual Secondary School Examination held on 03.03.2017. Submission of learned counsel for the petitioner is that the petitioner has not been arrested from the place of occurrence, moreover earlier he was granted benefit of Section 41(1) Cr.P.C. and released by the police.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances, let the petitioner surrender before the learned

Patna High Court Cr.Misc. No.77855 of 2018(2) dt.03-01-2019 2/2 court below within a period of six weeks from the receipt of the order of this Court and pray for regular bail and the learned court below after considering the fact that earlier the petitioner was granted benefit of Section 41(1) Cr.P.C. by the police and he did not misuse the same, shall dispose of the prayer for bail of the petitioner, if possible on the same day. With the above observation, this application is disposed of.
