JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 The petitioner apprehends his arrest in connection with Bathnaha P.S.Case No. 199 of 2018 registered under Sections 323, 341 and 498A/34 of the Indian penal Code and 3 and 4 of the Dowry Prohibition Act.
Allegation against the petitioner and other accused persons is of demanding dowry and subjecting the informant to harassment.
Submission of learned counsel for the petitioner is that petitioner is not the family member of the husband of the informant rather he is a villager and false and concocted allegation has been levelled against him.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,
Patna High Court Cr.Misc. No.77768 of 2018(2) dt.02-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Bathnaha P.S. Case No. 199 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
