JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This application, for grant of anticipatory bail, arises out of Bihia P.S. Case No. 373 of 2018, disclosing offences under Sections 420, 468, 471 and 472 of the Indian Penal Code. Allegation against the petitioner is that she secured appointment as Vikash Mitra on the basis of forged certificates. Submission of learned counsel for the petitioner is that no enquiry has been held to ascertain the genuineness of certificate of the petitioner and without enquiry, this present case has been lodged. Further submission is that petitioner is a lady and is ready to abide by any condition imposed on her. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within

Patna High Court Cr.Misc. No.78217 of 2018(2) dt.07-01-2019 2/2 six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -V, Ara, Bhojpur, in connection with Bihia P.S. Case No. 373 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is further subject to the condition that petitioner shall cooperate in investigation and appear as and when her appearance is require and further the petitioner will also make herself present and cooperate in the departmental enquiry, if any.
