JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This application, for grant of anticipatory bail, arises out of Forbesganj P.S. Case No. 430/18, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.

Allegation against the petitioners and others is of committing loot of Rs. Ten lakhs from the informant on the point of pistol and also of assaulting him.

Submission of learned counsel for the petitioner that he has no criminal antecedent and has falsely been implicated in this case and no such occurrence as alleged in the F.I.R has ever taken place.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of

Patna High Court Cr.Misc. No.78486 of 2018(2) dt.09-01-2019 2/2 anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
