2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 328, 302/34 of the Indian Penal Code.

3. As per prosecution case, petitioner along with another accused person named in the FIR, committed murder of father of informant by administering poison in order to grab consideration money of the land which was sold by deceased to the petitioner.

4. Learned counsel appearing for the petitioner submits that informant is not an eye witness to the alleged occurrence and only on suspicion, this petitioner has been made an accused in this case. He submits that the petitioner purchased a land from father of informant after payment of full consideration money and as such, there was no occasion or

Patna High Court CR. MISC. No.4418 of 2026(2) dt.16-02-2026 2/2 motive for petitioner to commit any offence. Father of informant was aged about 75 years and he may have died due to ailment. F.I.R. has been lodged after inordinate delay of ten days without any explanation which renders the entire prosecution case doubtful. Charge sheet has already been filed. Petitioner is in custody since 14.7.2025.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the nature of accusation, materials collected during investigation and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj, Rohtas in Dinara Police Station Case No. 590 of 2023.
