2. The petitioner seeks bail in connection with Andramath P.S. Case No. 118 of 2025 registered for the offence punishable under Sections 140(3), 96, 315, 64, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita and Section 4 of the POCSO Act.

3. As per the prosecution case, the accused persons had kidnapped the daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case and the petitioner was not even present on the spot.

5. The petitioner is in custody since 28.07.2025.

6. Learned APP appearing for the State and learned counsel for the informant have vehemently oppposed the prayer for regular bail of the petitioner.

7. From the statement of the victim recorded under Section 183 of the BNSS, it appears that she has not made any allegation against the petitioner.

8. Considering the submissions of learned counsel for the petitioner and the fact that the victim girl has not made any allegation against the petitioner, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addtiional Sessions Judge- VIIth-cum-Special Judge, POCSO, Madhubani/ concerned Court in connection with Andramath P.S. Case No. 118 of2025.
