The petitioner is apprehending his arrest in connection with Khagaria Mufassil P.S.Case no.204 of 2018 , registered for offences punishable under Sections 147, 149, 386, 448, 323, 504 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is that they came over the land of the informant, demanded Rangdari and also assaulted him as well as made indiscriminate firing also. It further appears that the petitioner is accused in one more case. Submission of the learned counsel for the petitioner is that earlier to that a case had been lodged by the petitioner's side against the informant and others, which is Anneuxre 2 to the petition and in order to save their skin, the present case has bee lodged.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Khagaria Mufassil P.S.Case No.204 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
