JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 Petitioner seeks bail in connection with Gopalpur P.S. Case No. 171 of 2019 registered for the offences punishable under Sections 272, 273, 420 of the Indian Penal Code and Sections 30(a), 35 and 38 of Bihar Prohibition and Excise Act. As per FIR police on information of carrying of liquor raised the place and intercepted several motorcycles and petitioner succeeded in fleeing away and it is said that there is recovery of liquor from all the motorcycles and from motorcycle of the petitioner there is recovery of 48 litres of liquor and he is accused in three other cases of similar nature. Submission of learned counsel for the petitioner is that he was not arrested at the spot and he is in custody since 22.11.2019.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.84870 of 2019(2) dt.06-01-2020 2/2 bail of the petitioner.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, once charge has been framed in this case, petitioner is at liberty to renew his prayer for bail in this case.

This application is, accordingly, dismissed.
