In this case the petitioners are seeking anticipatory bail in connection with Excise Case No. 246 of 2018 registered for offence punishable under section 30 (a) of the Bihar Prohibition & Excise (Amendment) Act, 2016. The Police on secret information had gone to village Bahrampur and recovered huge quantity of illegal liquor from the sugar cane field and on looking to the police the accused persons fled away from there.

Looking to the facts and circumstances of the case, the prayer for bail of the petitioners is rejected. However, if the

Patna High Court Cr.Misc. No.79118 of 2018(2) dt.10-01-2019 2/2 petitioners surrender and pray for regular bail, the court below without being prejudiced by the order of this Court, will take decision in accordance with law.
