The petitioner seeks bail in a case registered under Sections 379, 411/34, 461 of the Indian Penal Code. Allegation is that the accused persons including the petitioner committed theft of articles wroth Rs.5000/- in the shop of the informant and the petitioner was caught with stolen articles.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.09.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to have committed theft in kirana shop. He is alleged to have

From perusal of the seizure list, it appears that there is no signature of the petitioner on the said seizure list. There is no compliance of Section 100 of Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pratik Anand Dwivedi, learned J.M. 1st class, Gopalganj in connection with Jadopur P.S. case No.97 of 2019.
