The petitioner is apprehending his arrest in connection with Shahpur P.S.Case No.210 of 2019 registered for offences punishable under Sections 406 and 420 of the Indian Penal Code.
Prosecution case is that the petitioner has taken Rs.13 lac with respect to sale of a piece of land but he is not ready to execute the sale -deed.
Submission of the learned counsel for the petitioner is that the agreement was to sale the land within a period of ten months but before the expiry of that period, the present case has been filed. Moreover, he is still ready to return the amount, if some reasonable time is given to him.

No.83244 of 2019(2) dt.16-12-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a period of six weeks from the date of receipt of the order with a bank draft of Rs.03 lac in favour of the O.P.no.2 and once the same is deposited , the petitioner shall be released on provisional bail in connection with Shahpur P.S.Case No.210 of 2019 for a period of five months with condition to pay rest of the amount in five equal installment of Rs.02 lac (two lac) and once the total amount is deposited, the provisional bail of the petitioner shall be confirmed . It is also made clear that on an application filed by the O.P.no.2, the above amount shall be released in favour of the O.P.no.2 subject to final outcome of the case. With the aforesaid direction, this application is disposed of.
