The petitioner seeks bail in Tharthari P. S. Case No. 138 of 2019 instituted for the offence under Section(s) 341, 323,307,448, 354, 379, 504/34 of the Indian Penal Code. Subsequently Section 302 of the IPC was added. Learned counsel for the petitioner submits that the allegation of assaulting the informant by iron rod is against the co-accused Rajnish Kumar and so far as this petitioner is concerned, though he has been named among the four accused persons in the first information report but there are general and omnibus allegation against others. Learned counsel submits that the co-accused persons, namely, Sachin Kumar@ Dukhran and Indubhushan have been granted regular bail by learned

Patna High Court CR. MISC. No.83451 of 2019(3) dt.18-03-2020 2/2 coordinate Bench of this court in Cr. Misc. Nos. 84649/2019 & 1705 of 2020 respectively and the petitioner in custody since 19.10.2019 having no criminal antecedents.

Learned A.P.P. for the State has opposed the prayer for bail.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM 1st Hilsa, in connection with Tharthari P. S. Case No. 138 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
