JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 Petitioners apprehend their arrest in connection with Sohsarai P.S.Case No. 216 of 2018 registered for the offences punishable under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant, causing injuries.
Submission of learned counsel for the petitioners is that dispute arose with respect to procession of immersion of Goddess Durga and moreover the injuries are simple in nature. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt
Patna High Court Cr.Misc. No.78247 of 2018(2) dt.07-01-2019 2/2 of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Sohsarai P.S.Case No. 216 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioners have to co-operate in investigation, otherwise their bail bonds shall be cancelled.
