JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This application, for grant of anticipatory bail, arises out of Barsoi P.S. Case No. 04 of 2018, disclosing offences under Sections 341, 323, 498 of the Indian Penal Code and Section 3 /4 of the Dowry Prohibition Act.

Petitioner happens to be husband of the informant and allegation against him is of cruelty and harassment to the informant in connection with demand of dowry of Rs. Five lakhs. .

Submission of learned counsel for the petitioner is that earlier to lodging of the present case by the informant, the petitioner has filed the case for restitution of conjugal rights in the year 2014 which is Matrimonial Case No. 1027/14 and after four years, this present false case has been lodged by the informant. Further submission is that petitioner is still ready to

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Barsoi P.S.
