The petitioner seeks anticipatory bail in connection with Sikraul P.S.Case No. 04 of 2018, registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of the Bihar Excise Act.
As per F.I.R., allegation against the petitioner is that the police intercepted two accused persons and recovered 120 bottles of 180 ml Whiskey and it is alleged that they were carrying illicit wine from the shop of the petitioner. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing incriminating article has been recovered from the physical possession of the petitioner or premises of the
Patna High Court Cr.Misc. No.78376 of 2018(2) dt.08-01-2019 2/2 petitioner though, he is an accused in one more case. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Sikraul P.S.Case No. 4 of 2018 to the satisfaction of learned Special Judge, Excise, Buxar, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
