Petitioners seek pre-arrest bail in Biraul P.S.Case No.130/18 registered under Section 147, 148, 149, 341, 323, 504, 307, 354 and 379 of I.P.C.
Allegation against the petitioners is of assault to the informant and others.
Submission on behalf of the learned counsel for the petitioners is that there is case and counter case between the parties. Injuries are simple in nature.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, let the petitioners, above named, in
Patna High Court Cr.Misc. No.78929 of 2018(2) dt.11-01-2019 2/2 the event of their arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M., Biraul at Darbhanga, in Biraul P.S.Case No.130/18 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
