The petitioner is seeking anticipatory bail in connection with Sonbarsa Police Station Case No. 191 of 2018 registered for offence punishable under sections 272 and 273 of the Indian Penal Code and 30 (a) Bihar Prohibition and Excise Act 2016.

The police has recovered 21 litres of illegal liquor from the house of the accused person.

The learned counsel for the petitioner submits that and the petitioner is not involved in the illegal liquor though his brother has wrongly given the name of this petitioner about his involvement in the illegal liquor.

Looking to the facts and circumstances of the case,

Patna High Court Cr.Misc. No.79110 of 2018(2) dt.10-01-2019 2/2 the prayer for bail of the petitioner is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by the order of this Court, will take decision in accordance with law, preferably on the same day.
