JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This is an application for grant of anticipatory bail in connection with Shri Krishna Puri P.S. Case No. 238 of 2018, disclosing offences under Sections 341, 323, 386, 387, 427, 504/34 of the Indian Penal Code.

Allegation against the petitioner is of demanding Rangdari from the informant and others. Further, it appears that the petitioner is accused in two other cases. Submission of learned counsel for the petitioner is that the F.I.R. itself shows that the shop of informant and others were removed and due that dispute, the petitioner has falsely been implicated in this case. So far criminal antecedents of the petitioner are concerned, one is of pity nature and second is with respect to road blockage.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna-cum-Special Judge CBI-I, Patna, in connection with Shri Krishna Puri P.S. Case No. 238 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
