Petitioner, who is in custody, seeks bail in Bikram PS Case No. 190 of 2019 registered under Sections 414 of the IPC and Section 33 of the Indian Forest Act.

The allegation in the FIR is that the petitioner was one amongst four cutting mango tree near the government canal. It is alleged that some articles like iron-swear was recovered from the place of occurrence and that the petitioner was arrested on the spot.

Counsel for the petitioner submits that he has falsely been implicated in this case and that no stolen article has been recovered from his physical possession so as to attract Section 414 of the Indian penal Code. Petitioner is also in custody since 25.6.2019 and prior to the instant case there is no criminal antecedent of the petitioner.

Considering the aforesaid submissions prayer for bail of the petitioner is allowed.

No.85024 of 2019(2) dt.07-01-2020 2/2 Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VIth, Danapur, Patna in Bikram PS Case No. 190 of 2019 subject to the following conditions:- (I) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled. (Madhuresh Prasad, J) SNkumar/- U T
