The petitioner seeks bail in connection with Simri P.S. Case No. 140 of 2019, registered under Sections 399, 402, 120B, 379 and 411 of the Indian Penal Code and 37(b) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that the informant, along with other police personnel were present at Shaubhan Chowk for checking of vehicles, at that time, one Tata Sumo Gold vehicle came from Muzaffarpur side. On giving the signal to stop the vehicle, five persons, started to flee away, but, on chase one was apprehended, who disclosed his name Sandeep Kumar @ Putus Nut (petitioner). He also disclosed the name of his associates Dhandhan Choudhary, Ajay Nut, Bhirgun Radhe and Mithun Nut. On query, the petitioner, who was present, did not produce

Submission is that the petitioner is in custody since 28.08.2019 while the petitioner is accused in Hawai Adda P.S. Case No. 108 of 2018 registered for the offence under Sections 341, 323, 307 and 353/34 of the Indian Penal Code, but, he is on bail in that case.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Simri P.S. Case No. 140 of 2019 to the satisfaction of the Additional District Judge II-cum-Special Judge, Excise Act, Darbhanga. (Rajendra Kumar Mishra, J) Shamshad/- U T
