JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 Earlier petitioner was granted anticipatory bail by this Court vide order dated 6.4.2018 passed in Cr.Misc.No. 13150 of 2018 on the condition that petitioner had to deposit a Bank Draft of Rs.1,04,722/- within a period of one month in the court below and on such deposit he was directed to be released on bail subject to payment of Rs.5,00,000/- in five equal instalments in the first week of every following months.
Submission of learned counsel for the petitioner is that petitioner is an old person suffering from various ailments and as such he could not surrender and deposit the amount as directed by this Court and this application for modification has been filed for extension of time.

Patna High Court Cr.Misc. No.77580 of 2018(2) dt.02-01-2019 2/2 Having heard both sides and in view of casual approach of the petitioner before this Court, I am not inclined to interfere with the earlier order.
If petitioner surrenders and make prayer for regular bail, the same shall be considered on its own merit. With the above observation, this application is dismissed.
