JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 This is an application for grant of anticipatory bail in connection with Madanpur P.S. Case No. 136 of 2014, G.R. No.1413 of 2014, disclosing offences under Sections 147, 148, 149, 341, 323, 337, 353, 307, 124(A) of the Indian Penal Code and Section 27 of the Arms Act, 3⁄4 of the Explosive Substance Act and Section 17 of the CLA Act.

Allegation as per F.I.R. is that police received information that some Maoists have blocked the road and pelting stones on the police station and also set the police jeep on fire. Petitioners are not named in the F.I.R. later on their names transpired on the basis of videography after more than 3

Submission of learned counsel for the petitioners is that the petitioners were not named in the F.I.R. and no specific allegations have been attributed against them and they have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Madanpur P.S. Case No. 136 of 2014, G.R. No.1413 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
