JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 This application, for grant of anticipatory bail, arises out of Sono P.S. Case No. 87 of 2017, disclosing offences under Sections 147, 341, 448, 323, 308, 504, 506 of the Indian Penal Code.
Allegation against the petitioner is of assault by tangi on the head of informant.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and chargesheet has not been submitted under Section 307 of the Indian Penal Code. Further submission is that the earlier petitioner was given benefit of Section 41(A) of Cr.P.C. and was released during investigation of the case and now chargesheet has been submitted.

No.78829 of 2018(2) dt.11-01-2019 2/2 Having heard both sides, in view of the above facts, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below after considering the fact that the petitioner was earlier granted the benefit under Section 41(A) Cr.P.C. and was released during investigation, shall pass an appropriate order, if possible on same day.
