Petitioner apprehends his arrest in Awatar Nagar P.S. Case No.235 of 2018 registered under Sections 188, 272, 273, 308/34 of the Indian Penal Code and under Sections 30, 30(A), 38 and 41 of the Bihar Prohibition and Excise Act, 2016. The informant, a police official, alleged that he got information about the fact that Munna Choudhary and Vidya Choudhary were illegally selling illicit liquor from their house. On such the informant went to raid but from the house of Munna Choudhary two persons fled away after throwing some bags. From both the bags about six liters country made liquor was recovered.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.80022 of 2018(2) dt.11-01-2019 2/2 police official disclosed that from the house of Munna Choudhary two persons fled away. The house of the petitioner was not raided and nothing was recovered from the conscious possession of the petitioner.
Having considered the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge, Saran at Chapra in connection with Awatar Nagar P.S. Case No.235 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
