The petitioner seeks regular bail in connection with Special Case No. 169 of 2019 arising out of Daniyawan P.S. Case No. 143 of 2019 for the offence registered under Sections 341, 323, 354(B) of the Indian Penal Code and Sections 8 & 12 of the POCSO Act, 2012.

The allegation is regarding the petitioner having tried to outrage the modesty of the minor victim girl. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case on account of village rivalry. It is further submitted that the petitioner is having a clean antecedent and is languishing in

Patna High Court CR. MISC. No.83777 of 2019(3) dt.18-03-2020 2/2 custody since 04.10.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the period of incarceration of the petitioner herein, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act-cum-A.D.J.- I, Patna in connection with Special Case No. 169 of 2019 arising out of Daniyawan P.S.
