JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-02-2020 After some argument, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to challenge the order dated 02.03.2017 passed by the SubDivisional Officer, Jhanjharpur, whereby and whereunder the P.D.S. license of the petitioner has been cancelled, before the Appellate authority under Rule 32 sub-clause (iii) of the Bihar Targeted P.D.S. (Control) Order, 2016.
Accordingly, the present writ petition stands disposed off as not pressed, however, with the aforesaid liberty and in case the petitioner files appropriate appeal within a period of four weeks from today, the appellate authority would decide the

It is needless to state that immediately upon filing of the appeal by the petitioner, a copy of the show cause notice/enquiry report shall be furnished to the petitioner herein within a period of one week thereof and in case the petitioner is desirous of raising any additional ground, he would be at liberty to file additional affidavit within a further period of one week.
