This application for grant of regular bail arises out of Mufassil P.S. Case No. 141 of 2019 registered for the offence punishable under Sections 341, 323, 324, 307, 354, 354(B), 504 and 506/34 of the Indian Penal Code.

It is evident from the First Information Report that the occurrence had taken place over some land dispute. Allegedly, the accused persons were digging the land belonging to the informant for the purpose of construction of a house, which was objected to. The petitioner and other accused persons are said to have assaulted thereafter, the informant and her husband with iron rod.

Case diary has been called for.

On perusal of the case diary and the injury report, most of the injuries have been found to be simple in nature. The

Patna High Court CR. MISC. No.83733 of 2019(3) dt.03-07-2020 2/2 petitioner was allowed provisional bail by order dated 18.12.2019. There is no material in the case diary to indicate that the petitioner either tampered with the evidence or hindered investigation while on provisional bail.

Considering the genesis of occurrence and nature of allegation, this application is allowed.

The provisional anticipatory bail granted to the petitioner stands confirmed.
