JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 09-09-2019 Heard learned counsel for the petitioner; learned AC to AAG 11 for the State and learned counsel for the Central Cooperative Bank Limited (hereinafter referred to as the 'Bank').
2. The petitioner has moved the Court alleging deliberate disobedience of order dated 26.03.2008 passed in CWJC No. 2584 of 2007.
3. A show cause has been filed on behalf of the Bank, though copy of which has been served on learned counsel for the
Patna High Court MJC No.2658 of 2018 dt.09-09-2019 2/2 petitioner today, taking the stand that whatever was due has been paid and in fact against the petitioner Rs. 82,943/- is recoverable, due to which he has now filed the contempt petition after more than 10 years, the Court finds such contention to be correct.
4. The petitioner choosing to remain silent for over 10 years and then moving the Court, in the background that a few months prior to that he had been served notice with regard to certain amount which was found recoverable and directed to be deposited by him, the Court does not find that there has been any wilful or deliberate disobedience by the authorities of the writ Court's order.
