The petitioner seeks regular bail in connection with Runnisaidpur P.S.Case No453 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 .
Allegation against the petitioner is about recovery of 410 ltrs. of liquor from the Bhusa Ghar of the petitioner. Submission of the learned counsel for the petitioner is that it is open place and he is in custody for two months. Heard learned A.P.P. , who has opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to
Patna High Court CR. MISC. No.85579 of 2019(2) dt.13-01-2020 2/2 the petitioner, however, once the charge has been framed in this case the petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, this application is allowed.
