ANSHUMAN ORAL JUDGMENT Date : 09-01-2024 Heard learned counsel for the petitioner, learned counsel for the South Bihar Power Distribution Company Limited and learned counsel for the State.
2. Learned counsel for the petitioner seeks permission to withdraw the writ petition on the ground that the appellate order was passed in favour of the petitioner and under wrong advise, the present writ petition has been filed
Patna High Court CWJC No.3286 of 2018 dt.09-01-2024 2/3 challenging the appellate order. He further submits that appellate order is in favour of the petitioner and, therefore, he seeks permission to withdraw the writ petition.
3. Learned counsel for the South Bihar Power Distribution Company Limited submits that he has no objection in withdrawal of the petition.
4. At the time of passing the final order, this Court vide order dated 21.09.2023 in paragraph 15 has observed as follows:- "In that view of the matter, this Court would like the General Manager (Human Resources/Administration) to relook his order and, accordingly, on the representation of the petitioner, pass a fresh order."
It transpires to this Court that the word segment 'General Manager' has been typed wrongly in place 'Chairmancum-Managing Director, Human Resources/ Administration,' and similarly in paragraph-16 the word segment 'Memo No.626 dated 10.05.2016' has wrongly been typed in place of 'Memo No.1383 dated 16.09.2017' passed after setting aside the original order under the resolution No.626 dated 10.05.2016. This correction has been made by this Court on the date of passing the final order with a view to remove any further
Patna High Court CWJC No.3286 of 2018 dt.09-01-2024 3/3 confusion and the parties have also consented for the said correction.
5. Accordingly, this writ petition is disposed of as withdrawn.
