JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-01-2020 Petitioner seeks regular bail in connection with Birpur P. S. Case No. 77 of 2019 registered for the offences punishable under Sections 364, 302, 201, 387, 120B of IPC and Section 27 of the Arms Act.
As per prosecution case, the informant received an information that four persons including the petitioner has kidnapped his father on the point of pistol from the shop, on that information, he reached there and staff of his shop has narrated about the kidnapping of his father by the petitioner and other accused persons. Later on, dead both of his father was recovered.
Submission of the learned counsel for the petitioner is that as a matter of fact, on the confessional statement of the co-accused, and on suspicion, he has been named. He is in custody for six months and other accused person, namely, Mritunjay @ Miro @ Mritunjay Kumar was granted bail by this Court, vide order dated 10.01.2020

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that in para 110 one witness has also taken the name of the petitioner.
Having heard both sides, in view of the submissions, made above and as the co-accused Mritunjay @ Miro @ Mritunjay Kumar has already been granted bail and the allegation of petitioner is similar to that of co-accused, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-1, Begusarai, in connection with Birpur P. S. Case No. 77 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to co-operate in disposal of the trial and appear as and when required, otherwise, his bail bonds shall be cancelled.
