This is an application for grant of anticipatory bail in connection with Chandi P.S. Case No. 191 of 2019, registered for the offence punishable under Sections 379, 414/34 of the Indian Penal Code and Sections 11, 36(1) of the Bihar Minerals (Prevention of illegal mining Transportation and Stage Rule 2019 and Section 15 E.P. Act 1986).

The allegation is regarding the informant having reached at the place of occurrence along with the police personnels and found that a tractor was being loaded with sand and during the course thereof, the petitioners, who are stated to be the owner

Patna High Court CR. MISC. No.82963 of 2019(2) dt.21-01-2020 2/2 and the driver of the said tractor, had fled away. The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case and they are having a clean antecedent. It is further submitted that the petitioners had been contacted by some other persons for the purposes of carrying the sand and they have got no complicity in the alleged crime.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to admit the petitioners to the privilege of anticipatory bail. Accordingly, the petitioners are directed to be enlarged on anticipatory bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M.XII Bhojpur at Ara in connection with Chandi P.S. Case No. 191 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
