JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-06-2020 The petitioner seeks bail in anticipation of her arrest in connection with Alam Nagar P. S. Case No. 94 of 2016 dated 04.07.2016 instituted for the offences under Sections 420, 406, 409 and 34 of the Indian Penal Code. It appears from the F.I.R. that the petitioner, who at the relevant time was Mukhiya and her Panchayat Secretary did not complete the work of various projects which were entrusted to her.

It has been submitted on behalf of the petitioner that the present F.I.R. has been lodged in a hurry and that also without verifying the facts. During the course of investigation, it has been argued, the IO went to the place of

Patna High Court CR. MISC. No.85777 of 2019(3) dt.17-06-2020 2/2 work and found that almost all the work had been completed. There is no specific accusation of any embezzlement of public fund. In fact, the F.I.R. was lodged without verifying the afore-noted facts.

Some of the other accused persons of this case are stated to have been granted anticipatory bail. Regard being had to the nature of accusation against the petitioner, she is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Uda Kishunganj in connection with Alam Nagar P. S. Case No. 94 of 2016, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
