The petitioner seeks bail in connection with Balia P.S. Case No. 188 of 2018, registered under Sections 30(a), 32 and 41 of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving secret information about collecting the illicit liquor by Bhola Mahto in village Panhas, the informant, along with other police personnel, reached there. On seeing the police party, they moved from there boarding in Creta vehicle. After some time, information was also received to the effect that near dhaba of village Panhas a vehicle with liquor was caught, informant and other police personnel reached there and in a maize field, 276 bottles, each containing 750 ml, 1200 bottles, each containing 375 ml, 1080 bottles, each containing 375 ml, country made liquor covering

Submission is that petitioner is not named in the first information report. In course of investigation, the name of petitioner surfaced in paragraphs 138, 142 and 159 of the supplementary case diary. The petitioner has no criminal antecedent and is in custody since 26.10.2019. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Balia P.S.
