This application for anticipatory bail arises out of Bajpatti P.S. Case No. 228 of 2018/ G.R. No. 1126 of 2018, disclosing the offence under Sections 363 and 366-A of the Indian Penal Code.

The victim's mother is the informant. The petitioner and his family members have been implicated in this case with the allegation of their participation in kidnapping of the informant's minor daughter.

Learned counsel for the petitioner has submitted that the petitioner and the alleged victim have solemnized marriage and the allegation of kidnapping is incorrect.

Patna High Court CR. MISC. No.83204 of 2019(4) dt.25-06-2020 2/2 My attention has been drawn in this regard to an order of this Court dated 20.12.2018, passed in Cr. Misc. No. 73036 of 2018, whereby two other co-accused persons have been allowed anticipatory bail.

Considering the facts and circumstances, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in Bajpatti P.S. Case No. 228 of 2018/ G.R. No. 1126 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
