JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Darbhanga (Sadar) P.S. Case No. 286 of 2019 for the offence under Sections 328/379 of the Indian Penal Code. Allegation against the petitioner is that he was involved in administering intoxicant to the informant and his Tempo, Adhar Card and Mobile phone etc. have been taken away by him.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 02.09.2019. He further submits that the petitioner was not named in the F.I.R. and his name figured on the basis of confessional statement.
