Mr. Narsingh Tanti, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 30-01-2026 As both the criminal miscellaneous petitions have arisen out of same P.S. case, hence they are being decided together by a common order.
2. Heard the parties.
3. Petitioners seek regular bail in connection with Bihra P.S. Case No. 207/2023 dated 12.11.2023 registered for the
Patna High Court CR. MISC. No.88489 of 2025(3) dt.30-01-2026 2/3 offences punishable under sections 364, 302, 120B and 201 of the Indian Penal Code.

The main submissions advanced by petitioners' counsel are that this is the second attempt of the petitioners to get the relief of bail and their earlier prayer for the same relief was rejected by this Court vide orders dated 26.07.2024 and 13.09.2024 passed in Cr. Misc. Nos. 32857/2024 and 44038/2024 respectively and the fresh grounds entitling the petitioners to get the relief of bail are their long custody period and the examination of all material prosecution witnesses. It is further submitted that among the examined prosecution witnesses, all witnesses except the informant went hostile, and the copies of the depositions of some of the witnesses have been filed with the petitions. It is further submitted that both the petitioners have been languishing in jail since 13.11.2023, having fair and clean antecedent and the release of the petitioners on bail at this stage will not prejudice the prosecution in any manner.
5. Learned counsel appearing for the informant accepts the examination of all material witnesses of the prosecution and he is not opposing the prayer of the petitioners.
6. Considering the aforesaid submissions and mainly taking into account the examination of all material witnesses of
Patna High Court CR. MISC. No.88489 of 2025(3) dt.30-01-2026 3/3 the prosecution as well as the petitioners' custody period, this Court is now inclined to release the petitioners on bail. Accordingly, let the petitioners named-above be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the court concerned in connection with Bihra P.S. Case No. 207/2023.
