This application for grant of anticipatory bail arises out of Jamui P.S. Case No. 511 of 2019, disclosing offence under Sections 341,323,308,504 and 34 of the Indian Penal Code.

The informant is the aunt of the petitioners. It is alleged in the F.I.R. that when the informant had gone to the office of the Registrar for execution of sale deed, the petitioners came and started assaulting the informant's son who received injuries. From the injury report, it transpires that the informant's son received hair line fracture in the anterior part of second rib

Patna High Court CR. MISC. No.83388 of 2019(3) dt.26-06-2020 2/2 and other injuries has been found to be simple in nature. It appears from the F.I.R., that the dispute arose out of execution of sale deed, in respect of a piece of land, allegedly contrary to agreement for sale.

Considering the genesis of occurrence and the nature of allegation of assault, this application is allowed. Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jamui in connection with Jamui P.S. Case No. 511 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
