The petitioner seeks regular bail in connection with Kudra P.S. Case No. 113 of 2018 for the offence registered under Sections 341, 323, 325, 307, 504/34 of the Indian Penal Code. Latter on Section 302 of the I.P.C. was also added. It is alleged in the written report that co-accused, Jagdish Paswan, Lav Kush Paswan, Pappu Paswan and Pankaj Paswan assaulted the brother of the informant with slaps, lathi, danda etc. The informant went to save his brother then they also assaulted him with lathi, danda causing head injury. It is further alleged in the written report that this petitioner also arrived at the place of occurrence and abused the informant and his brother as well as assaulted them.

There is general and omnibus allegation in second part of the occurrence that he arrived and assaulted the informant and his brother. It is further submitted that similarly situated co-accused persons have already been granted bail by a coordinate Bench of this Court vide order dated 12.10.2018 and 04.12.2018 passed in Criminal Misc. No. 62818 of 2018 and Criminal Misc. No. 69490 of 2018. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 18.11.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Kaimur at Bhabua in connection with Kudra P.S. Case No. 113 of 2018.
